1. Controller and scope of this policy
The controller of your personal data is Agnieszka Olbert, trading under the “Agnes in Martinique” brand.
This policy applies to data processed through taximartynika.pl, the contact form, e-mail, telephone and — when you choose this channel — WhatsApp.
2. Data processed and sources
Most data is obtained directly from you. Depending on how you contact Agnes and the service requested, it may include:
- your name;
- e-mail address and phone number;
- planned travel or service date;
- number of passengers;
- pickup point, destination, hotel, apartment or marina;
- information about the requested service and the content of correspondence;
- billing information when a booking or service is completed;
- technical server-log data, such as IP address, browser type, date and time of connection and requested page address.
Please do not send special-category data, such as health information, beliefs or identity documents, unless this is genuinely necessary and has been agreed in advance.
3. Purposes and legal bases
Handling enquiries and preparing a service
Answering your message, checking availability and preparing information about the route, date and service terms.

Booking and providing the service
Organising a transfer, tour or agreed local support and communicating in connection with the service.

Protecting the website from misuse, investigating technical events and establishing, exercising or defending legal claims.

Direct marketing — only with separate consent
The website does not currently subscribe users to a newsletter. Any future e-mail marketing will require a separate, voluntary consent.

4. Whether providing data is required
Providing data is voluntary, but fields marked with an asterisk are required in order to answer your message. Without contact details and a description of your request, it will not be possible to reply or arrange the service. Details such as date, pickup point and passenger count help prepare the offer but may not always be required at the first stage.
5. Data recipients
Data may be shared only where necessary for the stated purposes with:
- hosting, e-mail, backup and technical service providers — currently including LH.pl;
- software and website-security providers;
- accountants, legal advisers or other professional advisers where necessary;
- public authorities where disclosure is required by law.
Your data is not sold, rented or shared with third parties for their own marketing purposes.
6. Contact form
The contact form sends the message to the controller’s e-mail address. The theme itself does not create a separate customer-enquiry database in WordPress. For security, the form uses anti-spam protection and a short-term sending limit based on a technical identifier derived from the IP address.
A short privacy notice and a link to this policy are displayed next to the form. Ticking the box confirms that you have read the information — it is not marketing consent.
7. WhatsApp, e-mail and external services
Using WhatsApp is optional. When you click the button, you use an external service that processes data under its own privacy policy. Depending on the provider’s infrastructure, data may also be processed outside the European Economic Area under the safeguards used by that provider.
If you prefer not to use WhatsApp, you can contact Agnes through the form, by e-mail or by phone. Links to Facebook, Instagram or other platforms lead away from this website and are subject to the privacy rules of the relevant platform.
8. Retention periods
- Enquiries that do not result in a booking: generally up to 12 months after the last contact, unless earlier deletion is appropriate or the correspondence is needed for legal claims.
- Service-related data: for the duration of the service and then for up to 5 years where necessary to establish, exercise or defend legal claims.
- Accounting documents and transaction evidence: for the period required by law, generally 10 years after the end of the relevant financial year.
- Consent-based marketing data: until consent is withdrawn and no longer than 3 years after the last active contact, unless deleted earlier.
- Technical and security logs: usually between 6 and 12 months, unless a longer period is needed to investigate an incident.
- Data-rights requests: information needed to demonstrate how the request was handled may be retained for up to 3 years after the case is closed.
After the relevant period, data is deleted or anonymised unless a longer period is required by law.
9. Your rights
Depending on the legal basis and circumstances, you may request:
- access to your data and a copy of it;
- rectification of inaccurate data and completion of incomplete data;
- erasure of data;
- restriction of processing;
- objection to processing based on legitimate interests;
- data portability where processing is based on consent or contract and is carried out by automated means;
- withdrawal of consent at any time, without affecting the lawfulness of processing before withdrawal.
To exercise your rights, contact kontakt@martynikagnieszka.pl. A response will be provided without undue delay and normally within one month. Where there is a reasonable doubt about the requester’s identity, additional information may be requested for verification.
10. Complaint to the supervisory authority
If you believe that your data has been processed unlawfully, you may lodge a complaint with the French supervisory authority:

You can also submit a complaint through the CNIL website. Before doing so, you are encouraged to contact the controller so that the matter can be clarified.
11. Cookies and similar technologies
The current theme does not install advertising tools, marketing pixels or external analytics. WordPress and the server may use only technical mechanisms necessary for security, administration, an authenticated administrator session and form protection.
These necessary mechanisms are not used to profile visitors. If analytics, embedded videos, maps, advertising or social plugins requiring consent are added in the future, an appropriate consent-management mechanism will be implemented before they are activated and this policy will be updated.
12. Data security
Reasonable technical and organisational measures appropriate to the nature of the website are used, including HTTPS encryption, restricted access to the administration panel, software updates, anti-spam measures and infrastructure-level backups. No internet transmission can, however, be guaranteed to be entirely risk-free.
13. Automated decision-making and profiling
Your data is not used to make decisions producing legal or similarly significant effects solely by automated means. The website does not carry out marketing profiling.
14. Children’s data
The services are not directed independently to children. A parent or legal guardian should make contact regarding travel or a stay involving a minor. Please do not send children’s data unless it is necessary for organising the service.
15. Changes to this policy
This policy may be updated if the website, services, tools, providers or applicable law change. The current version will always be published at the same address with the date of the latest update.
